Terms & Conditions of Use

The terms in this document apply to the sale of advertisements on websites operated by Eurosafe UK under the Construction Forums brand, being a private limited company registered in the UK, Company Number 3262851.

Definitions

The Supplier
The company supplying the Product to the Customer, in this case Eurosafe UK trading as Construction Forums.
The Customer
The person purchasing the Product from the Supplier, or the company on whose behalf the person is acting.
The Product
The goods or services provided by the Supplier to the Customer
Term
Whereby a Product is sold to the Customer for use during a limited period of time

Indemnity

The Supplier takes no responsibility for the content or accuracy of information provided for the purposes of advertising.

Content

The Customer may enter whatever content they wish, should they have purchased a Product which allows them to customise their advertisement text. The Customer is solely responsible for said content. The content may not contain any text that is:

Should material contravening these guidelines be found in advertisements, the Supplier reserves the right to remove this content without prior notice or compensation to the Customer.

Competitive Adverts

The Customer may not advertise goods or services which directly compete with the Supplier's products or services.

Delivery

Advertisements are delivered within 24 hours of receipt of customer payment. To avoid confusion, the time stamp recorded in our database against this advert shall be defined as the date of delivery.

Expiry

Where the Products are sold for a limited Term, the Customer shall have full use of the Products up to the date of expiry, whereupon the Products will remain accessible to the Customer via their private administration interface, but inactive to all other intents and purposes and inaccessible to other users of the website. The Customer shall be able to renew the Products at any stage after expiry. The date of expiry shall be calculated as the duration of the Term taken from the date that the Product was first delivered in a usable state to the Customer.

Cancellation

The Customer has the right to cancel their order within seven (7) working days of delivery. Delivery is defined as the time at which your advertistment(s) were set up, this fact having been conveyed to the customer by a confirmation email to the address supplied by the customer during the ordering process.

Cancellations may only be enacted subject to written confirmation from the customer, in the form of a letter, fax or email. A telephone message will be considered insufficient proof of intent for cancellation.
After cancellation the customer will be entitled to a full refund, and their purchased advertisements will be removed from our database.

No Guarantee

The Supplier makes no guarantee regarding the level of traffic generated by the Products. In addition, for the avoidance of doubt, the Supplier does not guarantee the Products will be operable at all times or during any down time as follows:

Force Majeure

No Party shall be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service.

Any Party asserting Force Majeure as an excuse shall have the burden of proving that reasonable steps were taken (under the circumstances) to minimize delay or damages caused by foreseeable events, that all non-excused obligations were substantially fulfilled, and that the other Party was timely notified of the likelihood or actual occurrence which would justify such an assertion, so that other prudent precautions could be contemplated.
